 * On July 30, co reached an agreement to settle all litigation in connection 
   with pending merger with PennantPark Floating Rate Capital 
 * On July 30, 2015, the parties to the action entered into a memorandum of 
   understanding regarding the settlement of the action 
 * Mou contemplates co will make certain supplemental disclosures relating to 
   merger with PennantPark Floating Rate Capital Ltd 
 * Says agreed to settle solely to avoid costs, and without admitting validity 
   of any allegations asserted by plaintiffs
