Scheme of arrangement under Part 26 of the Companies Act 2006 made between the Company and the Scheme Creditors in respect ofits US$200 million 10.0% notes due 2015 (ISIN: XS0553088708) issued under a trust deed dated 29 October 2010(the "Scheme")
1. We refer to the Scheme. Capitalised terms defined in the Scheme have the same meaning when used in this letter.
2. By an order dated 26 October 2015, the High Court of Justice of England and Wales (the "Court") sanctioned the Scheme.
3. We hereby confirm that the conditions precedent to the Restructuring Documents (if any) have been satisfied or waived. This is the Scheme Closing Date Notice as contemplated by Clause 10(d) of the Scheme.
4. We hereby confirm that the Scheme Closing Date is 28 October 2015.
This letter and any non-contractual obligations arising out of or in connection with it are governed by English law.
