Mirbud-Torpol appeal over Poland's biggest rail tender dismissed by Warsaw court
Mirbud-Torpol appeal over Poland's biggest rail tender dismissed by Warsaw court Sept 4 (Reuters) - A Warsaw regional court on Friday dismissed an appeal by a consortium of Mirbud MRB.WA and Torpol TOR.WA against the exclusion of its 4.5 billion zloty ($1.2 billion) bid for Poland's largest-ever railway tender.
The ruling means state rail infrastructure manager PKP PLK is likely to award the contract to modernise 100 km of the Rail Baltica line to the Track Tec consortium, including Unibep UNIP.WA, which had made a more expensive 5.22 billion zloty bid.
PKP PLK had picked the Mirbud-Torpol bid, the cheapest of five, in November 2025.
A procurement tribunal ordered it rejected in January over a 15,000 zloty environmental fine imposed on Mirbud.
Poland's top administrative court reopened the case over the fine in April, ordering the facts re-examined.
"We are treating the court's decision as the end of our involvement in the proceedings," Mirbud communications director Paweł Bruger said.
Torpol confirmed that the court had dismissed the consortium's appeal but declined to comment on the ruling.
A second-placed bid led by Budimex BDXP.WA was rejected on appeal in March.
