Nike, Lululemon agree to end patent dispute over Mirror home workout tech

By Blake Brittain

- Nike NKE.N and Lululemon LULU.O have agreed to dismiss a lawsuit in which Nike accused Lululemon's Mirror home workout system of infringing its patents, the companies said in a filing in Manhattan federal court.

The companies told the court on Wednesday that they would dismiss the case with prejudice, which means it cannot be refiled. Spokespeople for Nike and Lululemon did not immediately respond to requests for comment or provide information on whether they settled their dispute.

Nike sued Lululemon in 2022, alleging its Mirror Home Gym infringed six patents covering technology used in Nike's fitness equipment and smartphone apps that enables users to target specific levels of exertion, compete with other users and record their performance.

Lululemon denied the allegations in a court filing later that year.

Lululemon bought Mirror, an at-home fitness company with an interactive workout platform featuring live and on-demand classes, for about $453 million in July 2020.

The case was paused in 2023 while Lululemon challenged the patents' validity at a US Patent and Trademark Office tribunal. The tribunal declared the relevant parts of five of the six patents invalid, and Nike lost its appeals of two of the board's decisions earlier this year.

Nike separately sued Lululemon for patent infringement in 2023, alleging its running and training shoes infringed two Nike patents covering innovations in sneaker structure. A jury determined last year that Lululemon owed Nike $355,450 for infringing one patent, but US District Judge Arun Subramanian overturned the verdict in March after finding the patent invalid.

The parties agreed to dismiss Nike's appeal in that case in May.

The Mirror case is Nike Inc v Lululemon Athletica Inc et al, U.S. District Court, Southern District of New York, No. 1:22-cv-00082.

For Nike: Michael Harris of Arnold & Porter Kaye Scholer

For Lululemon: Kyle Mooney of Morrison & Foerster
