Delaware jury finds Parse infringed three genetic-sequencing patents (updated)
UPDATE 1-Delaware jury finds Parse infringed three genetic-sequencing patents Adds Roche comment
By Blake Brittain
Aug 31 (Reuters) - A Delaware federal jury found on Friday that Parse Biosciences, a unit of Qiagen QIA.DE, infringed three genetic-sequencing patents licensed by Roche ROPC.S to Scale Biosciences, part of 10x Genomics TXG.O, awarding $4.8 million in damages and finding the infringement was willful.
The willfulness finding could allow the judge to increase the damages award by up to three times.
The jury agreed that Parse's Evercode platform, used in biomedical research, infringed patents licensed to Scale Biosciences by Roche.
Parse and Qiagen said in a statement that they were disappointed with the verdict and that Parse will "continue to vigorously defend itself in this litigation."
10x said in a statement that it would seek enhanced damages, attorneys' fees and a permanent injunction against Parse following the verdict.
In response to a request for comment, Roche referred Reuters to 10x Genomics.
Scale sued Parse in 2022, alleging it infringed three cell-sequencing patents that Scale licensed from Roche. The patents' inventor Garry Nolan co-founded Scale.
Parse denied the allegations and argued that the patents were invalid. It has separately countersued Scale for infringing its patents.
Qiagen acquired Parse last December, while California-based 10x acquired Scale last August.
