Action filed by Societatea Energetica Electrica S.A. (Electrica) for the recovery of the damage identified by the Romanian Court of Accounts' Decision no. 12/27 December 2016
 
 
Electrica informs the shareholders and investors about the filing of a civil action on 27 November 2019, object of case no. 35729/3/2019 of the Bucharest Tribunal:
 
-    for underscoring the liability of the persons who have held the positions of directors and respectively, executive managers of Electrica for obligations not fulfilled and/or improperly fulfilled, according to art. 155 of Law no. 31/1990, which determined the damages retained by the Romanian Court of Accounts (RCA), as this actions has been approved by the Ordinary General Meeting of the Shareholders (OGMS) of Electrica dated 14 November 2019; as well as
 
-    against the representative of the Authority of Valuation of the State Assets in Electrica's OGMS dated 10 December 2008 and the issuer of the voting mandate for the respective OGMS, 
 
in order to implement the measures ordered by the RCA for remedying the deviation identified according to items 1-5 of the RCA Decision no. 12 / 27 December 2016 issued as a result of the control on the management of the patrimony of Electrica for the period 01 January 2013 - 30 June 2014.
 
The total value of the claims is RON 235,609,455, amount that shall be updated with the inflation rate, to which will be added legal interest calculated starting with the date of the damage, until the date of its full repair. The estimated value of the interest until 14 November 2019 is RON 47,275,221.
