    ** Adds Kounta appeal, seeks to set aside court's orders
    ** Intends to contest Kounta's appeal - TYR
    ** Court made orders on Nov. 16, restraining Kounta from
soliciting, inducing or attempting to persuade any Tyro merchant
to become merchant of any entity providing Acquiring Services
    ** Stock down 25.1% YTD as of last close
