Nov 16 (Reuters) - Sumitomo Heavy Industries Ltd  6302.T  
    
    * Says co has decided to accept the court's settlement 
recommendation, regarding the lawsuit filed by the City of Kyoto 
(the City) against the co 
    * Says if the City also accepts the settlement 
recommendation and 
the settlement is reached, the lawsuit at the Osaka High Court 
will end 
    * Says co shall pay a settlement amount of 15.38 billion yen 
to 
the City, the City shall waive any other claims against the co, 
and the co shall waive co's counterclaim against the City
